China Affirms Openness to EU Dialogue on Intellectual Property Amid WTO Dispute
Beijing, October 25, 2023
China has reiterated its openness to communication with the European Union (EU) regarding intellectual property (IP) issues, following the EU's recent complaint filed at the World Trade Organization (WTO).
On Monday, the Chinese Ministry of Commerce emphasized that channels of communication with the EU on IP matters remain \"always open.\" This statement comes in response to the EU's move to challenge China's judicial practices related to standard essential patents (SEPs) at the WTO.
According to the ministry, China received a consultation request from the EU on January 20. The ministry responded through an online statement, addressing media inquiries over the escalating issue.
\"China has strictly adhered to WTO rules and its accession commitments,\" the ministry stated. \"We have continually improved legislation and law enforcement related to the protection of intellectual property rights, and our achievements have been widely recognized.\"
The ministry underscored that China will handle subsequent matters in accordance with WTO procedures and is committed to firmly safeguarding its legitimate rights and interests.
Background on the WTO Complaint
The EU's complaint centers on China's judicial decisions concerning SEPs, which are patents essential for complying with international standards in various industries, including telecommunications and technology. The EU alleges that Chinese courts are limiting the ability of European patent holders to protect their IP rights, potentially forcing them into disadvantageous licensing agreements.
China's Commitment to Intellectual Property Protection
China has made significant strides in strengthening its IP protection framework in recent years. The government has implemented comprehensive legal reforms and enhanced enforcement mechanisms to align with international standards. These efforts aim to foster innovation, attract foreign investment, and promote fair competition.
Looking Ahead
The dialogue between China and the EU is expected to continue through WTO consultation mechanisms. Both parties have the opportunity to resolve the dispute amicably during the consultation phase before it advances to formal adjudication.
China's reaffirmation of open communication signals a willingness to engage with the EU to address concerns and find mutually beneficial solutions.
