China Pledges Stronger Legal Protection for Private Enterprises

The Supreme People’s Court (SPC) of China announced on Wednesday its commitment to enhance the law-based protection of property rights and personality rights for private enterprises and entrepreneurs. This move signifies a significant step towards bolstering the confidence of private businesses in the country’s legal system.

Emphasizing the need to prevent administrative and criminal interference in economic disputes, the SPC called for effective measures to minimize the negative impact of lawsuits on business operations and production. By safeguarding the interests of enterprises, especially micro, small, and medium-sized ones, the court aims to foster a more conducive environment for economic growth and innovation.

The SPC also pledged to combat the abuse of power, promote fair and reasonable judicial protection, and strengthen safeguards for scientific and technological innovation. These efforts are expected to encourage entrepreneurship and stimulate advancements in various sectors.

Data from the SPC revealed that approximately 1.27 million commercial cases of the first instance were settled across the country in the first half of this year, marking a 13.5 percent decrease year on year. This decline indicates progress in resolving economic disputes and reducing the litigation burden on businesses.

This commitment aligns with a recent resolution adopted by the 20th Central Committee of the Communist Party of China. The resolution emphasizes the improvement of the property rights system to ensure equitable protection for all economic entities, irrespective of ownership forms. It also highlights the importance of bolstering law enforcement and justice administration to protect property rights and rectify any administrative or criminal interference in economic disputes.

By enhancing legal protections and promoting a fair judicial environment, China aims to advance its modernization efforts and support the sustained growth of private enterprises. This initiative is expected to contribute significantly to the country’s economic resilience and global competitiveness.
