In a significant legal development for public health infrastructure, Kenya's Court of Appeal has temporarily lifted High Court orders that had previously suspended a critical health cooperation agreement between Kenya and the United States.
The ruling, delivered this Wednesday, allows the Kenyan government to resume the implementation of the health framework while a full appeal is pending. This framework, signed in December 2025, is part of a broader US-led global health financing initiative. According to court documents, this strategic model has already been adopted by other regional partners, including Rwanda and Uganda, highlighting a growing trend in health financing collaborations across the continent.
The path to implementation has not been without challenges. The High Court had earlier halted the agreement following a petition by the Consumers Federation of Kenya (COFEK). The federation raised several concerns, primarily centering on data protection, the level of public participation in the agreement's drafting, and overall constitutional compliance.
During submissions, the Kenyan government emphasized the urgency of the deal, arguing that the suspension had caused significant disruptions to essential health programs. Officials warned that continued delays risked hindering access to external financing necessary for immunization, disease control, and the modernization of digital health systems.
