First Overhaul in Three Decades Aims to Modernize Prison Management
In a significant legislative move, China's top legislature has adopted a major revision to the country's Prison Law this week. The revised legislation, passed by the Standing Committee of the 14th National People's Congress on Thursday, marks the first comprehensive overhaul of the law in three decades and is set to take effect on November 1, 2026.
Expanding Scope and Strengthening Oversight
The revised law dramatically expands its scope, increasing the number of articles from 78 to 121. A core aspect of the revision is the enhancement of supervision by procuratorial agencies over the execution of prison sentences, aiming to ensure greater legal compliance and transparency within the correctional system.
Furthermore, the law provides more detailed and standardized provisions for prison management. This includes specific measures for the protection of inmates' legitimate rights and interests, a point highlighted during the legislative process.
A Shift Towards Rehabilitation and Reintegration
Beyond management, the revised law signals a philosophical shift. It explicitly stresses the rehabilitation of inmates, stating that prison work should focus on transforming offenders into law-abiding citizens and helping them successfully reintegrate into society upon release.
During the deliberations, lawmaker Xian Tieke voiced support for the revision, noting that "it further balances prison security with human rights protection." This balance reflects the evolving priorities within China's judicial and corrections framework.
Addressing New Social Requirements
Justice Minister He Rong explained the rationale behind the long-awaited revision. She cited people's growing aspirations for fairness, justice, and security, alongside the ongoing improvement of law enforcement and judicial institutions, as creating new circumstances and requirements for prison work.
"It is therefore necessary to revise the Prison Law to elevate into legal provisions the experiences, practices and mechanisms explored over the past 30 years," Minister He stated, "to ensure that prison work moves forward orderly under the rule of law."
The forthcoming law also sets requirements for prisons, courts, and procuratorates to handle cases related to commutation of sentences and release on parole in a lawful, timely, and fair manner, aiming to strengthen the integrity of the entire correctional process.
As China's legal system continues to develop, this landmark revision to the Prison Law represents a pivotal step in aligning correctional administration with contemporary standards of justice, oversight, and social reintegration.
