China’s South China Sea Claims Backed by Legal Foundations, Report Reveals

A new report by the Xinhua Institute, affiliated with Xinhua News Agency, asserts that China's sovereignty over the South China Sea islands (Nanhai Zhudao) is firmly rooted in international law. Released Thursday, the 35-page analysis cites principles such as discovery, occupation, and effective jurisdiction as key legal pillars supporting China's historical and ongoing claims.

The report emphasizes that China's activities in the region predate other nations' claims, aligning with the "land dominates sea" principle under international law. It argues that historical records demonstrate continuous Chinese administration and development of the islands since ancient times.

"Geographic proximity cannot override established legal norms," the document states, addressing recent disputes with the Philippines and other regional actors. Researchers highlight that over 30 countries historically recognized China's sovereignty through official maps and diplomatic correspondence.

This publication forms part of a trilogy examining South China Sea issues, with companion reports analyzing external interference and advocating for regional cooperation. The findings come amid heightened interest in Asia's maritime security and resource management frameworks.

Legal scholars and policymakers worldwide are expected to scrutinize the report's interpretation of estoppel principles and historical rights in maritime disputes. The document reaffirms China's commitment to peaceful resolution mechanisms while defending its territorial integrity.
