China Open to Dialogue with EU on Intellectual Property Issues

China has expressed its openness to continued communication with the European Union (EU) regarding intellectual property issues, following the EU's recent complaint filed at the World Trade Organization (WTO) against China's judicial measures on standard essential patent disputes.

On Monday, the Chinese Ministry of Commerce stated that channels of communication with the EU on intellectual property matters remain open. The ministry's remarks came in response to media inquiries about the EU's request for consultations at the WTO on January 20.

The EU has raised concerns over China's policies related to standard essential patents, which are patents that claim an invention that must be used to comply with a technical standard. The EU alleges that China's measures restrict EU companies' ability to defend their patent rights.

The Chinese Ministry of Commerce emphasized that China has strictly adhered to WTO rules and its commitments upon joining the organization. It highlighted China's continuous efforts in improving legislation and law enforcement concerning the protection of intellectual property rights, achievements that have been widely recognized globally.

The ministry added that China will handle subsequent matters in accordance with WTO procedures and is committed to firmly safeguarding its legitimate rights and interests.

Standard essential patents are critical in industries such as telecommunications, where compliance with international standards is necessary for interoperability and market access. Disputes over these patents can have significant implications for global trade and technology development.

China's stance highlights its willingness to engage in dialogue to resolve trade disputes through established international mechanisms like the WTO, amid ongoing global discussions on intellectual property rights and fair trade practices.
