China's Ministry of Commerce has reaffirmed its commitment to maintaining open channels of communication with the European Union (EU) on intellectual property issues. This statement comes in response to the EU's recent complaint filed at the World Trade Organization (WTO) concerning China's judicial practices regarding standard essential patent disputes.
In an online statement released on Monday, the ministry acknowledged receiving a consultation request from the EU on January 20. \"Channels of communication with the EU on intellectual property issues are always open,\" the ministry stated, emphasizing China's willingness to engage in dialogue to address the concerns raised.
The ministry highlighted China's adherence to WTO rules and its commitments made upon accession. \"China has strictly followed WTO regulations and continuously improved legislation and law enforcement related to the protection of intellectual property rights,\" the statement read. \"Our achievements in this area have been widely recognized.\"
Regarding the EU's complaint, the ministry expressed that China will handle subsequent matters in accordance with WTO procedures, firmly safeguarding its legitimate rights and interests. \"We will address the issues through appropriate channels and continue to protect the rights of all parties involved,\" the ministry added.
The EU's complaint centers on China's judicial decisions that allegedly prevent EU patent holders from protecting their standard essential patents through foreign courts. The EU argues that these practices undermine their intellectual property rights and have significant economic implications.
China's open stance toward communication indicates a potential for dialogue and resolution between the two parties. Both China and the EU are key players in global trade, and cooperation on intellectual property matters is crucial for fostering innovation and economic growth.
