EU Scrutinizes Apple’s iPadOS for Compliance with Digital Markets Act

The European Commission announced on Monday that it will assess whether Apple’s iPadOS complies with the European Union’s Digital Markets Act (DMA), potentially impacting how users interact with their devices in the future.

Under the DMA, Apple must implement significant changes to its operating system. These include allowing users to set their default web browser, permitting alternative app stores on iPadOS, and ensuring that accessory devices like headphones and smart pens have effective access to iPadOS features.

Apple responded by publishing a 12-page compliance report on November 1, detailing the measures it has taken to adhere to the DMA requirements. In the report, the company stated, “Apple is committed to conducting business ethically, honestly, and in full compliance with applicable laws and regulations, including the DMA.”

The European Commission will now carefully assess whether Apple’s proposed measures are sufficient. This assessment will consider input from interested stakeholders and determine if Apple’s solutions effectively comply with the DMA.

Enacted in November 2022, the DMA aims to ensure that large online platforms, referred to as “gatekeepers,” operate fairly and promote competition. In September 2023, Apple was designated as one of six gatekeepers under this act.

In April 2024, the commission added Apple’s iPadOS to the list of core platform services subject to the DMA. This means that iPadOS must meet specific regulatory requirements designed to foster a more open and competitive digital market.

Failure to comply with the DMA can result in significant penalties. Gatekeepers that do not meet the act’s standards may face fines of up to 20% of the company’s total worldwide turnover in cases of repeated infringements.

As the European Commission proceeds with its assessment, the outcome could have far-reaching implications for both Apple and its users. Changes to iPadOS could alter user experience and open up new opportunities for competitors in the digital marketplace.
